These Terms and Conditions ("Terms") govern the use of https://komplytek.com/academy (the “Site”), applications, and other products and services ("Services") offered on or through the Site and/or the Application and/or through any modes, or format or storage/transmitting device (hereinafter collectively referred to as the “Komplytek Academy”). These Terms will apply to any service updates that we may update from time to time. These Terms also include Privacy Policy, Refund Policy, Cookies Policy, Accessibility Statement, the User Guidelines and any other terms and conditions, rules, policies or guidelines that Komplytek Academy may add to the site and/or communicate with you from time to time.
These Terms and Conditions apply to all users of the Site, including without limitation, all persons who create and / or make available Content ( as defined under the ‘Intellectual Property’ section below) on the Site (referred to as “Content Providers”); all persons who teach or instruct (referred to as “Mentors”) and users who access the Site to learn a subject or a skill (referred to as “Learners/ Students”) or users who access the Site otherwise (collectively referred to as “you”, “your”, or “User(s)”).
By using our Services, you hereby expressly accept and agree to be bound by these Terms, including the policies referenced in these Terms and such agreement forms a legally binding agreement between you and Komplytek Academy (“Agreement”). Therefore, please carefully read the Terms.
Komplytek Academy is an Edtech platform providing online / offline/ hybrid courses that are designed and tailored to meet the demand for specialized roles within the Corporate Sector
The Site is owned, managed, operated and offered by Komplytek Services Limited, a company incorporated under the (Indian) Companies Act, 2013, having its registered office at Office No. 208, Suneja Tower-1, District Centre Janak Puri, New Delhi- 110058 (“Komplytek Services Limited”). The services are offered only in India and in no other geography outside of India. Komplytek Academy is not responsible for anyone using the services outside of India
Komplytek Academy offers courses and content ("Course Offerings") of its own, from universities and other providers ("Content Providers"). Komplytek Academy reserves the right to cancel, interrupt, reschedule, or modify any Course Offerings, or change the point value or weight of any assignment, quiz, or other assessment
Komplytek Academy does not grant academic credit for the completion of Course Offerings. Unless otherwise explicitly indicated by a credit-granting institution, participation in or completion of Course Offerings does not confer any academic credit. Even if credit is awarded by one institution, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completing a Course Offering unless you have earned a course certificate or other equivalent documentation of your completion of the Course Offering. Komplytek Academy, mentors, and the associated Content Providers have no obligation to have Course Offerings recognized by any educational institution or accreditation organization.
Except as described in the Terms below, nothing in these Terms or otherwise with respect to your participation in any course or service offerings by Komplytek Academy establishes any relationship between you and any Mentor or any Content Provider institution beyond participation in the course offering
Komplytek Academy may also offer, either directly or indirectly (through other third party platforms), other incidental and ancillary services which may include without limitation question banks, mock tests, doubt-solving solutions, Live Mentorship, live videos, contests, scholarships, webinars and events (physical and/or online) and facilitating discussion forums.
For the purpose of the Site Terms, usage of the terms shall mean and include all the services referred to in this section and such other products or services as may be offered by Komplytek Academy.
Komplytek Academy reserves the right to discontinue any aspect of the Site at any time with or without notice at its sole discretion.
As a Learner, to access the Site and its content and use certain Services, you will be required to register and create an account on the Site by providing the requested details. To register on the Site you must be 13 years and above; or over the age at which you can provide consent to data processing under the laws of your country. Certain regions and Course Offerings may have additional requirements and/or different age restrictions. By using the Site, you, through your actions, affirm that the Age Requirement is met.
If you are not of the age where you can provide consent; by registering on the Site and/or by accessing it you confirm to us that your use of the Site is with the permission of your Parent(s) / Legal Guardian, and your Parent/ Legal Guardian has read, agreed and accepted to the Agreement; and in the event of any dispute between you and Komplytek Academy pursuant to your Agreement with us, the terms of our Agreement shall be applicable to and enforceable against your Parent / Legal Guardian. You acknowledge that Komplytek Academy does not have the responsibility to ensure that you conform to the aforementioned age requirements. It shall be your sole responsibility to ensure that the required eligibility is met.
You can register on the Site for free, however, courses and some of the Services offered on the Site may be chargeable, as specified. You are not obligated to purchase any product or use any Service offered on the Site.
Subject to these Terms and our Policies, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license right to use our Services. The rights granted herein are only for your personal, non-commercial use, unless you obtain our written permission otherwise. You also agree that you will create, access, and/or use only one Learner account, unless expressly permitted by Komplytek Academy, and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access
You agree not to share and/or distribute in any medium any part of the Site / Course Content without Komplytek Academy’s prior written authorization. You agree to receive installs and updates from time to time from Komplytek Academy. These updates are designed to improve, enhance, and further develop the Site and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. You agree to receive such updates (and permit Komplytek Academy to deliver these to you) as part of your use of the Site.
You agree not to collect or harvest any personally identifiable information, including account names, from the Site, nor to use the communication systems provided by the Site, unless otherwise mentioned herein.
You may send communications or queries; and submit suggestions, ideas, comments, questions or other information as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringement of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any other form of spam. In other words, ensure that your conduct on the Site is in accordance with the Site Terms.
You are responsible for maintaining the confidentiality of your account and password to access the Site and the courses you have purchased and agree to immediately change your password or inform us of any unauthorized access to or use of your username or password. You acknowledge that your account is personal to you and agree not to provide any other person with access to the Site and to restrict access to your device to prevent any unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account. Please notify us immediately of any compromise or unauthorized use of your account by emailing or by calling us on our helpdesk numbers.
You represent that the information provided by you at the time of the registration is correct, true and accurate, and you agree to update the same as and when there is any change in the said information. Please read our Privacy Policy to understand how we handle your information.
Kindly make sure that the device that you use is compatible with our system/software to use the Site and avail the Services offered therein.
For Learners, Komplytek Academy does not charge any fee for registration and account creation. However, all the courses and certain Services offered by Komplytek Academy are chargeable and access is restricted unless you have paid the same. The details of the Services and applicable features along with their corresponding prices can be found on the Site.
The terms that are applicable to your purchase -
● Purchase of a course will allow you access only to the content available under the course which you have purchased and not the entire course content.
● Before proceeding to purchase any Course, please read and understand the details of the course – content, fees, duration, validity - you intend to purchase on the Site. If you are unclear about any part of the offering or need further clarification, then please feel free to write to us prior to your purchase at the email address provided in the “Contact US” section of the Site.
● Please note that the prices may stand revised from the time of your first purchase of the Course.
Komplytek Academy offers paid Courses and Services for a fee. Unless otherwise stated, fees are quoted in local currency. You are responsible for paying all fees charged and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. Fees may vary based on your location and other factors, and Komplytek Academy reserves the right to change any fees at any time at its sole discretion. However, you are not required to pay the revised fee if you have already paid for the same. THe revised fee will be applicable only for the new programs / services you buy. Any change, update, or modification will be effective immediately upon posting through the relevant Services.
The Course fees are payable in full and in advance and are valid until the completion of the applicable period or until otherwise cancelled or terminated in accordance with the terms of this Agreement.
Once a course is purchased through your account on the Site, you can request for cancellation or refund within 7 days of the first session or the program introduction class. Upon such cancellation, we will refund the fees after deducting INR 1000 or 10% of the program fee, whichever is higher. No requests for a refund of the Course fee will be entertained once a candidate attends the second session. Once a candidate registers and pays for the Course, they will not be able to defer their program completion to another batch unless authorized by Komplytek Academy. Refunds will also be applicable in the case of duplicate payments made in error. For any refund, you will have to write to us at the email provided under the “Contact Us” section of the site.
Your payments to Komplytek Academy shall be subject to applicable taxes including without limitation Goods and Service Taxes (GST) and Value Added Taxes (VAT) or other similar taxes as may be applicable in your country of residence/from where you have created your account on the Site.
We further reserve the right to offer custom plans and pricing, discounts, special offers in addition to what is offered on the Site
We use third-party payment gateways and/or aggregators (referred to as “Third-Party Service Providers”) to process payments applicable to the Services offered by us. Third-Party Service Providers may also charge you fees to use or access their services and may require your personal information to complete any transaction for the Site.
Further, to facilitate completion of your payments to us, you may be redirected to an external website operated by the Third-Party Service Provider. We cannot and do not (i) guarantee the adequacy of the privacy and security practices employed by or the content and media provided by the Third-Party Service Provider or its respective websites or (ii) control collection or use of your Personal Information by such Third-Party Service Provider. Hence, prior to using any services offered by a Third-Party Service Provider, we suggest that you read their terms and conditions, privacy policy and other policies that may apply, to understand their terms of usage and to understand how your Personal information is being processed. Komplytek Academy is not affiliated to any Third-Party Service Provider and neither Komplytek Academy nor any of the Third-Party Service Providers are agents or employees of the other. Komplytek Academy is only facilitating various payment options to you and is not offering the payment by itself in any manner.
Please note that all fee payments are collected by Komplytek Academy only through the Site and not through any third parties (except Third-Party Service Provider(s)).
Other than Komplytek Academy, no person, including without limitation, Content Providers or any third-party platform, are allowed to offer any discounts on the Subscription prices offered on the Site. Komplytek Academy shall not be liable for any claims arising from such unauthorized discounts / offers offered by any person (including any third- party platform or Content Provider), other than Komplytek Academy.
When you visit the Site, you are communicating with us electronically and therefore expressly consent to receive communications from us electronically. By providing your contact information while registering with us, you authorize Komplytek Academy, its affiliates, and their respective employees, agents, and contractors to initiate electronic communications by email, telephone calls, WhatsApp or such other mode of communication with respect to your use of the Site and regarding the products and services offered by Komplytek Academy and its affiliates.
These communications may be made by or on behalf of Komplytek Academy, even if your phone number is registered on any state or federal do not call list. Telephone calls may be recorded. You acknowledge that your telephone operator and/or internet service provider may have levied certain charges on you with respect to availing their services for accessing the Komplytek Academy courses, and you agree to be responsible for all such charges, and Komplytek Academy will not be responsible for any such charges.
If you opt out of promotional communications, we may still send you transactional communications, such as service announcements, administrative and legal notices, and information about your account, without offering you the opportunity to opt out of these communications. Opting out of promotional communications only affects future communications from us. If we have already provided your information to a third party (as stated in our Privacy Policy) before you changed your preferences or updated your information, you may have to change your preferences directly with that third party.
All our collection, processing, sharing and storing of any Personal Information collected from you shall be in accordance with our Privacy Policy. Kindly read the same to understand the security measures undertaken by Komplytek Academy to safeguard your Personal Information. Should you have any queries in respect of the same, please feel free to write to us on the email id mentioned on the “Contact Us” page of the Site. We do not sell your Personal Information to third parties.
Komplytek Academy and / or its affiliates own all information and materials (in whatever form or media) provided or communicated to you by or on behalf of Komplytek Academy including but not limited to, the Site, illustrations, letters, images, ideas, concepts, the layout, design, flow, look and feel of the Site, logos, marks, graphics, audio files, video files, any software which is owned by or licensed to Komplytek Academy and / or its affiliates, the underlying source and object code, instructions embedded in any form of digital documents and other data, information, or material made available to you by Komplytek Academy.
You acknowledge and agree that you do not acquire any ownership or rights to the Komplytek Academy Content or the Site by use of the Site. You acknowledge and agree that the Komplytek Academy content is protected by the copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws and any unauthorized use, reproduction, modification, distribution, transmission, republication, display or performance of the Komplytek Academy content and any component thereof is strictly prohibited.
You confirm and undertake not to utilize any data mining tools, robots, or similar data gathering and extraction tools to extract for re-utilization of any substantial parts of this Site, without Komplytek Academy’s express prior written consent.
We welcome your suggestions, reviews, ideas, comments, and other feedback regarding the Services ("Feedback") so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” By submitting any Feedback, you grant us a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media without any restriction or any compensation to you
Komplytek Academy has the right but not the obligation to monitor and edit or remove any activity or content and assumes no liability for any content posted by you or any third party.
In respect of the entire Site, Komplytek Academy reserves the following rights:
● The right to put on-hold or reject or suspend or terminate your registration on the Site for the purpose of complying with the legal and regulatory requirements.
● The right to remove you without notice if you violate any provisions of the Site Terms.
● The right to modify, terminate, or refuse to provide Services at any time for any reason, without notice.
● Notwithstanding anything contrary stated in the Site Terms, in its sole discretion, Komplytek Academy may remove anyone from the Site at any time for any reason.
● The right to access your account in order to respond to requests for technical support, to maintain the safety and security of the Site, legal purposes and for other legitimate business purposes, as necessary, in Komplytek Academy’s discretion.
Your access to the Courses may occasionally be suspended or restricted to allow for repairs, maintenance, or other technical reasons at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. You agree that Komplytek Academy will not be liable for any losses that you may incur if for any reason all or part of the Site is unavailable at any time or for any period for use.
YOU AGREE THAT THE SITE, CONTENT, AND ALL MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND YOUR USE OF THE SITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, KOMPLYTEK ACADEMY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM AND EXCLUDE ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. TO THE FULLEST EXTENT PERMITTED BY LAW, KOMPLYTEK ACADEMY EXCLUDES ALL WARRANTIES, CONDITIONS, TERMS OR REPRESENTATIONS ABOUT THE ACCURACY, SECURITY, RELIABILITY, QUALITY, AVAILABILITY OR COMPLETENESS OF THE SITE, USER-GENERATED CONTENT ON THE SITE, OR THE CONTENT OF ANY SITES SO LINKED AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF USER-GENERATED CONTENT OR ANY CONTENT ON THE SITE, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY USER-GENERATED CONTENT OR ANY OTHER CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY OTHER CONTENT THAT IS POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE AS KOMPLYTEK ACADEMY IS STRICTLY AN INTERMEDIARY AS UNDER THE INFORMATION TECHNOLOGY ACT, 2000. KOMPLYTEK ACADEMY DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER- GENERATED CONTENT OR THE SITE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND KOMPLYTEK ACADEMY WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF USER-GENERATED CONTENT OR SERVICES. To the fullest extent permitted by Law, in no event shall Komplytek Academy, its affiliates, their respective officers, Directors, Employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, losses or expenses or consequential damages whatsoever resulting from your access or use the site or anything connected to it, whether in contract, tort including negligence, statute or any other theory) even if Komplytek Academy has been advised or has knowledge of the possibility of the potential loss or damage in advance or otherwise. Liability of Komplytek Academy for a breach of a condition or warranty implied by law or otherwise, and which cannot be excluded, is limited to the fee charged for supply of the goods or services, in Komplytek Academy’s sole opinion.
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Komplytek Academy, its affiliates, their respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) charges that occur through third party vendors for fee payment (ii) your use of and access to the Komplytek Academy; (iii) your violation of any term of the Site Terms; (iv) your violation of any third party right, including without limitation any copyright, property, or privacy right; (v) violation of any applicable laws. This defence and indemnification obligation will survive these Terms and Conditions and your use of the Komplytek Academy.
Komplytek Academy shall be the entity rendering the Services and, accordingly, the Agreement shall be governed by and construed in accordance with the laws of India; and you agree, as we do, to submit to the exclusive jurisdiction of the courts at New Delhi, India.
● Legal Notices: In the event of any other disputes or claims arising from the use of the Komplytek Academy, please get in touch with us at academy@Komplytek.com
● Modification, Amendment or Termination: Komplytek Academy may, in its sole discretion, modify or revise the Agreement and policies at any time, and you agree to be bound by such modifications or revisions. Your continued use of the Site post any modification of the Agreement shall be taken as your consent and acceptance to such modifications. Nothing in the Agreement shall be deemed to confer any third-party rights or benefits. You are advised to check our Site frequently to see recent changes and to keep yourself updated with the most recent updates.
● Service Providers : Any links provided to third party websites (Content Providers and integrated service providers), or information supplied about them on the Site are supplied as a convenience. Linked sites are not under the control of Komplytek Academy and its affiliates are not responsible for any third party linked sites, the contents of such sites, any use of the same, or for third party information. The inclusion of a link or third party information does not imply endorsement by Komplytek Academy of the linked site or third party information, any organization or person associated with the linked site or third party information, or any products or services offered or marketed through the linked site or by the third party.
● Force Majeure : Komplytek Academy shall not be liable for failure to perform, or the delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by events substantially beyond its control, including but not limited to acts of God, acts of the public enemy or governmental body in its sovereign or contractual capacity, war, terrorism, floods, fire, strikes, epidemics, civil unrest or riots, power outage, and/or unusually severe weather.
● Severability : If a provision of this Section is found to be invalid, illegal or unenforceable in any respect, the court may modify it to make such provision enforceable or in the alternative remove it without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
● Complaints : if Komplytek Academy receives from any User a complaint of misconduct against you, in any form, or if Komplytek Academy otherwise deems necessary, Komplytek Academy reserves the right to suspend or terminate your access to the course/s at any time, with or without giving any notice or reason.
